The Nevada System of Higher Education (NSHE) is governed by the Board of Regents, whose authority lies in Article 11 of the state Constitution.

The Board of Regents has created a set of governing documents, referred to as "The Handbook" which govern the NSHE. In particular, Title 2 of the Handbook is referred to as "The Code," and constitutes the employment contract of the professional employees of the System, which include academic, administrative, and executive faculty.

Under the Code, each campus is permitted to create Bylaws which govern the academic affairs of the campus, and, as required, create standards and due process for a variety of personnel matters for professional staff.

University Bylaws are usually proposed by the Faculty Senate, then approved by a two-thirds majority vote of the faculty of the university, then by the President and the Chancellor.

Each college, school, department may create their own Bylaws by vote of the faculty, which are subject to approval by the President. The Administrative Faculty create their own Bylaws as a unit, which are recommended to the President by the Executive Committee of the Senate.

The UNLV Bylaws must conform to the policies of the Board of Regents established in the Handbook. Unit Bylaws on campus must conform to both the Regents' Handbook and the UNLV Bylaws.
